SUMMARY NOTICE OF PENDENCY OF CLASS ACTION

A lawsuit has been filed by an America Online ("AOL") subscriber against AOL. The suit alleges generally that AOL promised but did not deliver unlimited access to America Online and the Internet for a fixed rate.

By Court Orders of January 30, 1997, and January 31, 1997, this matter was certified as a class action on behalf of all America Online subscribers throughout the United States who were subscribers to America Online on December 1, 1996 or who became subscribers on said date or thereafter. The Court has appointed Steven F. Schwab as the Class representative and Ben Barnow, Barnow and Goldberg, P.C., 105 West Madison Street, Suite 2200, Chicago, Illinois, 60602, Larry D. Drury, Larry D. Drury, Ltd., 105 West Madison Street, Suite 2200, Chicago, Illinois, 60602, and Lawrence A. Sucharow, Goodkind Labaton Rudoff & Sucharow LLP, 100 Park Avenue, New York, New York, 10017 as Class Counsel.

A detailed notice was posted on a Web site or on a URL (http://www.notice.com/AOL) on or about February 27, 1997. That notice describes the litigation, the arrangement AOL reached with certain state attorneys general, your rights to participate in or be excluded from the class action, the identity of Class Counsel and defense counsel, and how you may receive further information about the class action.
